Terms of Use
Version 1 October 2026
This document is being reviewed by our legal advisers and may be updated. We will tell you about any material change.
These terms explain how MindCare works, what you can expect from us and what we expect from you, including how bookings, payments, cancellations and refunds work.
1. About these terms
These terms are an agreement between you and Senditoo Zambia Limited, which operates MindCare Zambia ("MindCare", "we", "us"). By creating an account or using MindCare you agree to them and to our Privacy Policy. If you do not agree, please do not use MindCare.
2. Who can use MindCare
You must be 13 or older. Young people aged 13 to 17 use MindCare Teens, and some services, such as booking paid therapy, are only for adults or need a parent, guardian or sponsoring programme. You must give accurate information and keep your sign-in details private. An account is for one person only.
3. MindCare is not an emergency service
MindCare cannot respond to emergencies. If you or someone else is in immediate danger, call 991 (police) or 992 (ambulance), go to the nearest hospital, or call LifeLine Zambia on 933. If you tell Tula or a therapist something that suggests serious risk, our safeguarding staff may contact you or, where necessary, others who can help.
4. What MindCare provides
MindCare helps you find and book verified mental health professionals and gives you self-care tools: mood tracking, journaling, guided practices, wellness checks and Tula, our AI wellness companion.
- Therapists on MindCare are independent professionals. We check their credentials before their profile goes live, but each therapist is responsible for the care they give.
- Wellness checks and questionnaires are not a diagnosis, and MindCare does not prescribe medication.
- Tula is an AI companion, not a therapist. It can be wrong and should not be relied on for medical, legal or financial decisions.
- We cannot promise a particular outcome from any session or tool.
5. Bookings, payments and cancellations
- The price of a session is shown in Kwacha before you pay. A self-pay booking is confirmed once your mobile money payment succeeds.
- You can cancel free of charge up to 24 hours before your session and receive a full refund.
- If you cancel less than 24 hours before, or do not attend, the session is not refunded, because your therapist has kept that time for you.
- If your therapist or MindCare cancels, you always receive a full refund.
- Refunds are made by MindCare to the mobile money number or method you paid with. Sessions paid for by an employer, NGO or other sponsor return to that programme's budget instead.
- You can request to move a session from your Sessions page, subject to your therapist's availability.
6. Sponsored and insured access
If an employer, NGO, school or insurer pays for your care, their programme rules (for example, the number of funded sessions) also apply. They never see your messages, journal or clinical notes; see our Privacy Policy for what they can see.
7. Using MindCare respectfully
Do not harass, threaten or discriminate against anyone; share other people's private information; post harmful, sexual or illegal content; impersonate anyone; or try to access accounts or data that are not yours. Peer circles are moderated, and messages that break these rules may be removed.
8. Your content and ours
What you write and record on MindCare stays yours. You allow us to store and process it only to provide the service, as described in the Privacy Policy. The MindCare name, design, software and content belong to Elson Chigerwe and Senditoo Zambia Limited and may not be copied without permission.
9. Suspending or closing accounts
You can delete your account at any time from your profile. We may suspend or close an account that breaks these terms or puts others at risk, and will tell you why unless the law or someone's safety prevents it. If we close your account for reasons that are not your fault, we will refund any upcoming paid sessions.
10. Responsibility
We work hard to keep MindCare available and safe, but it is provided as it is and may sometimes be unavailable. To the extent the law allows, we are not responsible for indirect losses, or for the advice or care given by independent therapists. Nothing in these terms limits rights you have under Zambian consumer protection law or our responsibility for our own negligence.
11. Law and disputes
These terms are governed by the laws of the Republic of Zambia. If you have a complaint, please contact us first so we can try to put it right. Disputes that cannot be resolved are decided by the courts of Zambia.
12. Changes and contact
We may update these terms. We will tell you in the app before any material change takes effect; continuing to use MindCare after that means you accept the new terms.
